If you received one or more telephone calls that used the recorded voice of Mike Huckabee to deliver a message as part of a campaign for the movie “Last Ounce of Courage,” you may be a class member in a class action lawsuit.
Plaintiffs Ron Golan and Dorit Golan (“Plaintiffs”) filed a lawsuit alleging that Defendants violated the Telephone Consumer Protection Act of 1991 (“TCPA”) by initiating approximately four million telephone calls during a marketing campaign for the movie “Last Ounce of Courage” without the consent of the call recipients. Plaintiffs allege the telephone calls were prerecorded, appeared as surveys to recipients about traditional American values, and told recipients if they believed in freedom and liberty, they would enjoy the movie.
Defendants deny these claims and have asserted numerous defenses. The Court granted a Stipulation of Dismissal with prejudice as to one of the Defendants, Mission City Management, Inc., but other Defendants remain. This notice is not an admission by Defendants that the claims Plaintiffs assert in this case are valid, or that there has been any wrongdoing or violation of law. The Court has not ruled on the merits of the Plaintiffs’ claims or on Defendants’ denials or other defenses. The purpose of this notice is simply to advise you of this case and its potential effect on any rights you may have.
