A class action Settlement involving Publix Super Markets, Inc. (“Publix”) received final approval in the United States District Court for the Middle District of Tennessee on November 12, 2014.
As a result, Settlement payments of $48.55 were mailed on November 26, 2014 to all Class Members who did not timely request exclusion from the Settlement. Settlement checks and must be cashed on or before May 25, 2015.
This informational website relates to a settlement in a class action lawsuit which alleges that Publix violated the Fair Credit Reporting Act (“FCRA”). Publix denies that it violated the law in any way, but the parties have agreed to resolve the lawsuit by a settlement.
The settlement includes people who applied at any Publix retail store and whose application included a liability release regarding consumer reports in electronic or written form and on whom Publix procured a background check for employment purposes at any time from March 12, 2012 through May 13, 2014.

|Do Nothing||If you did nothing a settlement payment for $48.55 was mailed to you on November 26, 2014. You are not allowed to sue Publix for the same issues as in this lawsuit again.|
|Ask to be Excluded by October 3, 2014||If you did not want to be included in the case and the settlement, you were requested to exclude yourself. This is called “opting out.” This is the only option that allows you to sue Publix for these same issues again. This deadline has passed and exclusion requests are no longer being accepted.|
|Object by October 3, 2014||You had the option to write to the Court about why you don’t like the settlement. You could not object if you opt out. The deadline to object has passed and objections are no longer being accepted.|
|Go to a Hearing on November 10, 2014||You had the option ask to speak in Court about the fairness of the settlement. The fairness hearing took place on November 10, 2014.|
